How Pre-Construction Deposit Structures Work

Most Miami new developments use a staggered deposit structure tied to construction milestones. Your money sits in escrow — protected by Florida Statute 718 — until the building receives its Certificate of Occupancy. Here's the standard structure:

Step 1 · Contract
10%
Due at signing. Held in escrow. Fully refundable during rescission period (typically 15 days).
Step 2 · Groundbreaking
10%
Due when construction begins. Still held in Florida escrow per Condo Act.
Step 3 · Top-Off
10%
Due when the building reaches its highest floor. Not all buildings require this milestone.
Step 4 · Closing
70%
Balance due at closing — either cash or mortgage. This is when you receive title and keys.

Florida law (§718.202) requires deposits on condominium contracts to be held in escrow in a Florida financial institution until closing. Developers cannot use your deposit funds for construction. Full pre-construction guide →
